Aftermath of Elections
On Tuesday, Nov. 29, the State Canvassing Board made elections official, although two election outcomes remain uncertain. The board approved plans for taxpayer-funded recounts in House districts 3A and 3B because the vote count difference was less than .5%. Since our last update, House minority leadership has been elected, committee structure has been decided and chairs have been appointed. Expect more updates on committee member assignments in upcoming issues of Ewald at the Capitol.

Walz Cabinet
Despite Gov. Tim Walz’s successful re-election bid, the executive branch is going through changes. Gov. Walz reappointed just 16 cabinet members, leaving 6 positions vacant. The open positions include commissioners in the departments of Health, Education, Revenue, Public Safety, Labor and Industry, and the Iron Range Resources and Rehabilitation Board. Gov. Walz hopes to fill these positions by mid-December. Expect updates on the new commissioners in upcoming issues of Ewald at the Capitol. Leadership The latest round of leadership elections for the 2023-2024 biennium has concluded with House Republicans electing Representative Lisa Demuth (Cold Spring) to serve as the minority leader. Following her election, she appointed Rep. Paul Torkelson (Hanska) to serve as Deputy Minority Leader, Rep. Jim Nash (Waconia) to serve as Minority Whip; as well as Rep. Dave Baker (Willmar), Representative-elect Elliot Engen (White Bear Lake), and Rep. Spencer Igo (Grand Rapids) to serve as Assistant Minority Leaders.

Election Brings Change

Election day 2022 will shape local, state and federal policy for years to come. All 201 seats in the Minnesota Legislature, as well as all constitutional offices, Minnesota’s U.S. congressional seats, and several county and local seats were up for election. Redistricting this year also meant that all candidates were running in newly drawn districts, creating a lot of uncertainty on the outcome.

It will take some time for the dust to settle now that the election is over. The first weeks following the election will be busy for new and familiar faces alike, regardless of who controls the Minnesota House and Senate. After voting on party leadership, caucuses in both bodies will have to sort out committee structure, appoint new committee chairs and make committee assignments. In addition, members will have to settle into their offices and pick their seats in the respective chambers. This will occur in the coming weeks — so we will have to wait until closer to the start of the 2023 session for the dust to settle.

So far, Sen. Kari Dziedzic (DFL-Minneapolis) has been elected as the Majority Leader in the Senate, and Sen. Mark Johnson (R-East Grand Forks) has been elected as the Minority Leader. The Senate DFL caucus also elected Sen. Bobby Joe Champion (DFL-Minneapolis) as President, Sen. John Marty (DFL-Roseville) as Finance Chair, and Sen. Ann Rest (DFL-New Hope) as Tax Chair. In the House, Rep. Jamie Long (DFL-Minneapolis) has been elected as the Majority Leader. Rep. Melissa Hortman (DFL-Brooklyn Park) will remain the Speaker of the House. Expect more updates on committee assignments and House minority leadership elections in upcoming issues of Ewald at the Capitol.

Although election results will not be made official by the state canvassing board until Nov. 29, Democrats held on to their House majority (70-64) and obtained a narrow majority (34-33) in the Senate. DFL Gov. Tim Walz and Lt. Gov. Peggy Flanagan were elected to another term as well as the incumbent Democrats in each constitutional office.

However, we are awaiting pending recounts in several races in northern Minnesota. In House District 3A, Republican candidate Roger Skraba beat Rep. Rob Ecklund by just 15 votes. In House District 3B, Republican Natalie Zeleznikar is 35 votes ahead of Rep. Mary Murphy. The narrow margins in these two races automatically triggered a recount. Results will not be final until these recounts are completed.

November Election Just Ahead

The November election is just weeks away. A reminder that every constitutional office, congressional office, the state senate, and the state house of representatives is on the ballot. Ewald Consulting has prepared a voter guide outlining information on the candidates for the state legislative races. You can find that link in this update.

Looking Ahead to 2023

Despite reaching a global budget agreement, the 2022 regular session ended without a bonding bill, a tax bill, and several other supplemental budget bills. 2023 is a budgeting year, where the legislature and the governor must agree to a two-year state budget. If they fail to do so and a budget is not enacted by June 30, 2023, Minnesota could face a shutdown of state government services.

Control of the 2023 legislature remains uncertain ahead of election day, but a few key factors will certainly come into play for the new legislature. First, 2022 was a redistricting year. Incumbents running for re-election are doing so in seats that are in some cases vastly different than the districts they faced in the last election cycle. Regardless of election results, the 2023 legislature is likely to introduce a near-historic number of new faces onto the scene at the Capitol. A total of 47 legislators retired after the 2022 session, and the count increases to 59 when you include members seeking office in the other body or seeking elected office elsewhere. These retiring legislators represent more than 600 years of experience and knowledge of the legislative and budget processes.

Midsummer Updates
Early voting has begun for the August 9 primaries. Register to vote at the link in our resources section at the end of this newsletter, or ensure you bring all necessary paperwork for same-day voter registration at your voting location. APM Research Lab has created a resource to analyze poll results for the 2022 election. In addition, we will provide this information in all upcoming editions of Ewald at the Capitol until the November election. In budget news, the Minnesota Department of Management and Budget (MMB) estimates an increase in the state general fund for 2022. In its July monthly update, MMB estimates that net general fund receipts for FY22 are now estimated to total $30.329 billion, $2.927 billion (10.7 percent) more than projected in the February 2022 Budget and Economic Forecast. However, MMB noted that some of this increase is the result of the timing of payments from Pass-Through-Entities (PTE).

Hero Pay Applications
During the 2022 session, the legislature passed a bill to provide $500 million in one-time bonus checks to pandemic frontline workers who qualify. The deadline to apply for these checks passed with nearly 1.2 million individuals applying, almost twice as many as were expected to qualify. The Minnesota Department of Labor and Industry must review these applications to determine who is eligible according to parameters set by the legislation. Next month, applicants will receive an email to let them know of their eligibility, though they would still be able to appeal this decision. Checks are expected to be out sometime in early fall, once the size of payment and pool of recipients is confirmed. Poll Watching APM Research Lab put together a page to track and analyze poll results for this year’s election season in Minnesota. It includes a summary of poll results, candidate lists, fundraising summaries, and forecasted election outcomes as available. It tracks this data for the Governor, State Auditor, Attorney General, and Congressional races. Primaries
The August 9 primary is only 18 days away. Minnesota voters will decide who they want to represent their party in the 2022 congressional and legislative races. Voters will also vote in contested primaries for local races such as county commissioner and city council on their primary ballot. At the legislative level, there are 25 Senate primaries and 19 for the House. Several incumbents in the House and Senate are facing primary challenges. Incumbents facing challengers (Senate):

No Special Session, Retirement, and more

No Special Session
It’s been almost a month since the Minnesota Legislature adjourned sine die from its 2022 regular legislative session. During the regular session, the legislature failed to pass several major omnibus appropriation or supplemental bills including education, taxes, public safety, and health and human services. After weeks of discussions behind closed doors, legislative leaders announced an impasse in negotiations last night, stating that there will not be a special session to tackle these unresolved issues from the regular session.

Retirements
Now that candidate filings have officially closed for the 2022 election, the full scope of legislative retirements is finally clear. A total of 47 legislators have retired from the Minnesota Legislature. The number increases to 59 when you include members seeking office in the other body, with 11 representatives hoping for a seat in the Senate, and one senator running for the House. Eight of these retired members are seeking other elected office. Notably, Jeremy Munson and Jen Schultz are running for Congress, in Minnesota Congressional Districts 1 and 8 respectively. The retiring legislators represent nearly a quarter of the 201-seat legislature, and they take along with them 600 years of experience. The next edition of Ewald at the Capitol will include information on all major party candidates who have filed for office in the Minnesota House and Senate.

One Week Left for Legislative Session
With one week of the 2022 legislative session left, there is still much to be done before the May 23 constitutional adjournment date. There is still a significant portion of the $9.25 billion budget surplus unspent, and leaders in each body are at odds with what to spend it on. Big ticket items up for debate include education funding, public safety, long term/disability care, and tax relief. This past week the House and Senate have moved through mostly smaller and noncontroversial bills while conference committees have been trying to work out differences between the omnibus bills passed by each chamber. If conference committees agree to a final version of their omnibus bill, those bills will be sent back to each floor for passage and then on to Governor Walz for signature.

Two Weeks Left for Legislative Session
With about two weeks left in the legislative session, the House and Senate continue to hold lengthy floor sessions to debate, amend and pass their large omnibus bills. These bills are a chance for legislators to pass the legislative priorities set at the beginning of the session. This process will continue in the next few weeks as the legislature and the governor work to reach a final agreement on the budget. This week started off with Gov. Walz signing the Unemployment Insurance trust fund/frontline worker pay bill. The Senate hit the ground running on Monday with floor debate on their Health and Human Services Omnibus Bill. The House did not convene on Monday in observance of Eid al-Fitr, which marked the end of Ramadan. More information about other bills heard this week can be found below.

Health and Human Services Omnibus Bill
On Tuesday, the House debated the Health and Human Services Omnibus bill (HF 4706). This bill combined three bills into one: the omnibus human services bill (HF 4579); the omnibus health bill (HF 4706) and articles 1-4 from the omnibus early childhood bill (HF 4735). In total, the bill would appropriate $768 million for FY22-23. This includes $270.7 million for health programs and $478.7 million for human services and early childhood programs. The bill passed with a vote of 69-64. A conference committee will be appointed to work out the differences between SF 4410 as passed by the Senate last Tuesday. The Senate passed its Health and Human Services Omnibus bill with a vote of 61-5. The Senate bill appropriates $1 billion for long-term care, personal care, and disability waiver service rate increases; $322 million rescue package to address staffing crisis in care facilities; $90 million rate increases for skilled nurse visits, home health aide visits, home care nursing, and home care therapy services.

State of the State, Unemployment Insurance Trust Fund, and more

State of the State
Gov. Tim Walz presented his annual State of the State address last Sunday evening. The speech was delivered in person to a joint session of the legislature for the first time since 2019. The 54-minute speech touched on the issues of Child Care, Education, Mental Health Care, Public Safety, Paid Family Leave and Health Care. Walz reflected on the challenges of the COVID-19 pandemic, expressing optimism about the direction of the state’s recovery, saying, “Our budget reserves have hit a record high, and our COVID infections and hospitalizations have hit record lows.” He urged for compromise from the Legislature, stressing that the projected $9.25 billion budget surplus should leave room for a deal on Unemployment Insurance/Frontline Worker Pay.

Unemployment Insurance Trust Fund
Following Gov. Walz’s call for action at the State of the State, the House passed HF 3166 late Monday evening. Back in February, the Senate passed SF 2677, the legislation proposing to repay the federal government and replenish the state’s unemployment insurance trust fund to pre-COVID levels. Protecting Minnesota’s employers by paying back the federal loan and funding a surplus in the Unemployment Trust Fund is one of the highest priorities for Senate Republicans.

For months, the House DFL held off, only willing to replenish the fund under the condition of expanded frontline worker pay. On Monday night, the House finally passed HF 3166 with amendments to include the House DFL’s priorities for frontline worker pay and unemployment benefits for hourly school employees. Passage of this bill set up the process to begin the work to reach agreement.

The House’s urgency was likely sparked by today’s deadline, which would kickstart higher payroll taxes for employers to replenish the fund. First-quarter tax bills reflecting the increase started going out in March and are due April 30. Any employers who already paid the increased first-quarter tax would receive a refund. In addition to replenishing the UI trust fund, the final bill includes one of the House DFL caucuses’ most pressing priorities: frontline worker pay. The House’s bill includes $500 million to provide additional pay to workers who worked on the frontline during the pandemic. This includes health care, law enforcement, school employees and grocery store workers.

The House and Senate appointed a conference committee, which met late Thursday evening to hammer out the differences between the two bodies’ versions of the bill. The committee adjourned at 11:50 p.m. with an agreement that includes the Senate Republicans’ priority to refill the Unemployment Trust Fund, and the House Democrats’ priority to expand frontline worker pay. The deal will include $500 million for frontline workers such as nurses and long-term care employees. The checks are expected to be approximately $750 per person for the 667,000 workers who are eligible to apply for them. The agreement also appropriates $2.7 billion to refill the Unemployment Trust Fund before employers face tax hikes on Saturday. However, DEED Commissioner Steve Groves has said that the agreement has come too late and that employers need to pay the amount they were billed and wait for credits and/or refunds to be issued in the 2-3 months that he expects it will take for DEED to “unwind” this issue.

Third Committee Deadline
Today is the last day before the legislature’s Easter/Passover break — a much-needed break for many legislators, staff, lobbyists and advocates. Today’s third and final committee deadline requires committees to act favorably on major appropriation and finance bills. The week has been jam-packed with committee hearings to act on their respective omnibus budget bills. The Senate’s Omnibus Tax Committee was the first bill to be passed in the Senate. The bill passed on April 7 with a vote of 42-24. However, because Minnesota’s Constitution requires tax bills to originate in the House, the Senate tax bill was laid on the table after the vote. Expect more omnibus bill debates once the legislature returns from break.

Governor to Deliver State of the State Address
Gov. Tim Walz is set to deliver his fourth Gubernatorial “State of the State” address Sunday, April 24 at 6 p.m. The speech will be given to a joint session of the Minnesota State Legislature at the Minnesota House Chamber. This is only the second time he’s delivered it to an in-person audience since he took office in 2019. The last two were delivered remotely from a social studies classroom at Mankato West High School in 2021 and from the governor’s mansion in 2020.
